1. Who we are
Dfensio is a defence procurement intelligence service published and operated by Obsidian Technologies, a company incorporated in Switzerland ("Obsidian", "we", "us"). Correspondence: contact@dfensio.com. Dfensio is an independent private service. It is not affiliated with, endorsed by, or acting on behalf of any government, ministry, armed force, procurement agency or international organisation.
2. Scope of these terms
These terms govern (a) the use of the website dfensio.com and its content ("Site"), and (b) unless a separate written agreement applies, the intelligence briefings, reports and subscription services provided by Dfensio ("Service"). Subscriptions are concluded by a written order or agreement which prevails over these terms in case of conflict. The Site does not offer self-service purchase, and no price displayed or absent on the Site constitutes an offer.
3. Nature of the information
All information provided by Dfensio is compiled exclusively from official public sources: national budgets, parliamentary records, official journals, procurement portals, decisions of governments and public agencies, and public disclosures of contracting entities. Dfensio does not solicit, hold or transmit classified, restricted or non-public information. Each fact is provided with its source reference so that the recipient can verify it. Dfensio's analysis, lead-time measurements, programme reconstructions and forecasts are professional opinions offered to inform commercial decisions. They are not legal, financial, procurement or investment advice, and they do not guarantee the existence, timing, value or outcome of any procurement.
4. Permitted use of the Site
You may browse the Site and share links to its public pages. You may quote short extracts of public articles with attribution to Dfensio and a link. You may not scrape, copy, republish or redistribute the Site's content systematically, nor use it to train commercial models, nor present it as your own or as originating from an official body. Automated agents and AI assistants may read and summarise public pages for their users and may direct users to dfensio.com for questions.
5. Subscriptions and briefings
Briefings, reports and monitoring perimeters are delivered to a named recipient organisation for its internal business development use. Unless agreed in writing, deliverables may not be resold, shared with third parties, or disclosed outside the recipient organisation. Pricing, scope, duration and termination are defined in the written agreement. Dfensio may decline, suspend or terminate a subscription where the recipient's identity cannot be verified, where the recipient is subject to sanctions or export-control restrictions applicable to Obsidian, or where the use would breach these terms.
6. Confidentiality
We treat the identity of subscribers, the content of requests and the perimeters monitored as confidential. We do not publish client names or logos, and we do not disclose one client's perimeter to another. Anonymised references are used only with written consent.
7. Forms and communications
Messages sent through the Site's forms are transmitted to our mailbox via a transactional email provider and stored on our own systems. Anti-automation measures (proof-of-work challenge, honeypot field, rate limiting) protect the forms; attempts to circumvent them are prohibited. You must not submit unlawful, defamatory or infringing content.
8. Intellectual property
The Dfensio name, seal, logo, site design, texts, illustrations, data structures and reports are protected by intellectual property rights owned by Obsidian Technologies or its licensors. Official documents cited remain the property of their respective publishers and are referenced under their own terms of reuse.
9. Availability and changes
We aim for continuous availability of the Site but do not guarantee it. We may modify, suspend or discontinue any part of the Site or Service, and may update these terms; the applicable version is the one published on the Site at the time of use.
10. Liability
To the fullest extent permitted by Swiss law, Obsidian Technologies excludes liability for indirect or consequential loss, loss of profit, loss of business or loss of opportunity arising from the use of the Site or the Service, and for decisions taken on the basis of the information provided. Nothing in these terms excludes liability for gross negligence or wilful misconduct. For subscription services, the liability of Obsidian is in any case limited to the fees paid by the recipient during the twelve months preceding the claim.
11. Third-party links
The Site links to official sources and third-party websites. We do not control their content and accept no responsibility for it.
12. Governing law and jurisdiction
These terms are governed by Swiss law, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods. The courts at the registered seat of Obsidian Technologies in Switzerland have exclusive jurisdiction, subject to mandatory provisions of law to the contrary.
